Terms of Service

These Terms of Service ("Terms") govern your access to and use of TransferSecure (the "Service"), operated by Rudra Coresoft Technologies Private Limited ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using TransferSecure, you confirm that you are at least 16 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

TransferSecure is a file transfer platform that allows users to upload files, generate shareable download links, and send those links to recipients. The Service includes:

• File uploads with automatic virus scanning
• Shareable download links with optional password protection
• Configurable transfer expiry
• Email notifications (transfer received, download alerts, verification codes)
• Registered accounts with subscription tiers (Free, Pro, Team)
• Guest / anonymous sending via email-verified one-time codes

3. Accounts

3.1 Registration

To access certain features, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

3.2 Account security

Notify us immediately if you suspect unauthorized use of your account. We are not liable for loss arising from unauthorized access not caused by our negligence.

3.3 Account deletion

You may delete your account at any time from the Settings page. Upon deletion, your account data and all associated transfers will be permanently removed. This action cannot be undone.

4. Acceptable Use

You agree not to use TransferSecure to:

• Upload, store, or distribute files containing malware, viruses, or malicious code.
• Share content that is illegal, infringing, defamatory, obscene, or violates third-party rights.
• Distribute child sexual abuse material (CSAM) -any such content will be reported to the relevant authorities immediately.
• Send unsolicited bulk emails, spam, or phishing messages through the notification system.
• Attempt to circumvent security measures, virus scanning, or access controls.
• Use automated scripts, bots, or scrapers without prior written consent.
• Interfere with or disrupt the Service, servers, or connected networks.
• Impersonate another person or entity.
• Use the Service for any activity that violates applicable laws.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

5. File Uploads & Content

5.1 Ownership

You retain all ownership rights to files you upload. We do not claim any intellectual property rights over your content. By uploading, you grant us a limited, temporary license to store, transmit, and deliver those files to your designated recipients -solely to operate the Service.

5.2 Virus scanning

Uploaded files are automatically scanned for viruses and malware before download links become active. Files flagged as unsafe are immediately quarantined and recipients will not be able to download them. We make reasonable efforts to detect threats but cannot guarantee 100% detection.

Scanning limitation: Files up to 200 MB are actively scanned. Files exceeding 200 MB are accepted but undergo limited scanning due to technical constraints. You are solely responsible for ensuring that any file you upload - regardless of size - does not contain malware, viruses, or any other malicious code. TransferSecure shall not be held liable for any harm caused by undetected malicious content in files that exceed the active scanning limit.

5.3 File retention

Files are retained until the transfer's expiry date, then automatically and permanently deleted. You may also manually delete transfers at any time. Orphaned uploads (started but never confirmed) are cleaned up within 2 hours.

6. Subscriptions & Payments

6.1 Free tier

Free accounts are subject to storage limits, transfer size limits, and default expiry periods as described on our Pricing page.

6.2 Paid plans

Paid subscriptions (Pro, Team) unlock additional features including larger transfer sizes, extended expiry, password protection, download notifications, and team workspaces. Details are listed on the Pricing page and may be updated from time to time.

6.3 Billing

Payments are processed by DODO Payments. By subscribing, you authorize recurring charges (monthly or yearly). You may cancel at any time; paid features remain active until the end of the current billing period.

6.4 Refunds

Fees are generally non-refundable. If you experience a significant service disruption caused by us, you may request a pro-rated refund by contacting [email protected].

7. Intellectual Property

The TransferSecure name, logo, interface, design, and underlying code are the property of Rudra Coresoft Technologies Private Limited and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you agree to the practices described in the Privacy Policy.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The Service will be uninterrupted, error-free, or completely secure.
• All uploaded files will be successfully delivered to recipients.
• Virus scanning will detect 100% of all threats.
• Your data will never be lost -always keep your own copies of important files.

10. Limitation of Liability

To the maximum extent permitted by law, Rudra Coresoft Technologies Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business interruption, arising from your use of the Service.

Our total aggregate liability shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100 USD, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Rudra Coresoft Technologies Private Limited from any claims, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use of the Service.
• Your violation of these Terms.
• Content you upload or transmit through the Service.
• Your violation of any third-party rights.

12. Termination

We may suspend or terminate your access at any time, with or without cause or notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (Liability, Indemnification, Governing Law) will survive.

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to provide advance notice of significant changes.

14. Changes to These Terms

We may revise these Terms from time to time. The "Effective date" at the top will be updated accordingly. Continued use after changes take effect constitutes acceptance. If you disagree, stop using the Service and delete your account.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Rudra Coresoft Technologies Private Limited operates, without regard to conflict of law provisions.
